Construction law

Real estate projects are always complex. Not only in the preparation and implementation, but also from a legal point of view.

If you also work cross-border, you will face even more legal challenges. How do you enter into negotiations? Which contract is most suitable? Which law and which general terms and conditions apply? And what about if your Dutch employees start working in Germany?

You will also be faced with the necessary questions during the construction period. Who is responsible for setbacks and delays? How do we deal with additional work? What do you do if your invoices are not paid? And who is liable if something goes wrong? These are all matters that are often arranged slightly differently in Germany than in the Netherlands.

Heisterborg International guides Dutch companies that want to discover the German market or have been successfully on the road for some time.

Architectural law

Architectural law is also regulated slightly differently in Germany than in the Netherlands.

For example, German law has a compensation scheme for architects with the HOAI, with minimum and maximum rates. Several lawsuits have been brought before the European Court of Justice regarding this arrangement in recent years.

The construction and architectural law specialists at Heisterborg International have a lot of experience in guiding Dutch architects on the German market. We know what opportunities there are, but also what pitfalls you may encounter along the way. We are happy to help you seize those opportunities and avoid the pitfalls.

You can contact Heisterborg International for:

  • advice on and drawing up architectural contracts
  • advice and negotiations on fees (taking into account the provisions of and case law on the HOAI)
  • advice, negotiations and procedures regarding damage and liability
  • advice and procedures on (payment) disputes
